Iowa man sentenced to 16 years for setting LGBTQ flag on fire

Register Staff Reports

Published 9:53 a.m. CT Dec. 19, 2019 | Updated 9:42 p.m. CT Dec. 19, 2019

An Ames man was sentenced Wednesday to about 16 years in prison after he set fire to a church's LGBTQ flag in June.

Adolfo Martinez, 30, of Ames, was found guilty last month of third-degree arson in violation of individual rights — hate crime, third-degree harassment, and reckless use of fire as a habitual offender.

He was arrested after stealing a pride banner hanging at Ames United Church of Christ, 217 6th St., and burning it early June 11 outside Dangerous Curves Gentleman’s Club, 111 5th St., police said.

Martinez admitted to police that he lit the banner on fire with lighter fluid and a lighter after stealing it from the church, according to court documents.

Story County Attorney Jessica Reynolds said the hate crime charges were added because Martinez is suspected of criminal mischief against someone's property because of "what it represents as far as sexual orientation."

He faced a maximum of five years in prison for the hate crime and arson charge and a maximum of a year and month for the other two charges, according to Iowa sentencing guidelines. Court records list him as a habitual offender, allowing him to be sentenced to a longer prison term.

Fifteen years in Iowa jail for burning pride flag

19 December 2019

A US judge has handed down a sentence of at least 15 years to a man who stole an LGBT pride flag from a church and burned it outside a strip club.

Adolfo Martinez, 30, admitted to the media that he took the flag from Ames United Church of Christ due to his animosity towards homosexuals.

He was found guilty last month of hate crime harassment, reckless use of fire and being a habitual offender.

The incident occurred around midnight on 11 June in downtown Ames, Iowa.

Police say the crime spree began at Dangerous Curves, a strip club, when police were called because a man was making threats. By the time they arrived, he had already been kicked out by bar staff.

After leaving the club, Martinez then travelled to the church and ripped down its flag. He then returned to the strip club where he used lighter fluid to burn the flag in the street. He also threatened to burn down the bar.

...

Story County Attorney Jessica Reynolds said Martinez was the first person in the county's history to be convicted of a hate crime.

"The hard reality is there are people who target individuals and commit crimes against individuals because of their race, gender, sexual orientation," she told the Ames Tribune.

Iowa man gets 16 years for stealing church’s pride flag & burning it outside STRIP CLUB

RT - Question More!

19 Dec, 2019 22:37 / Updated 13 hours ago

Stealing a Pride banner from a church and burning it outside a local strip club has landed an Ames, Iowa resident in prison for sixteen years, on hate crime charges.

Adolfo Martinez, 30, has been found guilty of a hate crime, third-degree harassment and reckless use of fire for stealing. He was arrested after police said he stole a pride banner hanging at the Ames United Church of Christ on June 11.

Martinez later burned the purloined flag, doused with lighter fluid, outside the Dangerous Curves Gentleman’s Club, which had actually been kicked him out earlier that day. He had also threatened to burn down the club.

Martinez admitted to burning the flag and was found guilty last month. He was sentenced on Wednesday to 16 years behind bars. The harsh sentence is mostly due to the hate crime charge, which is a class D felony.

Story County Attorney Jessica Reynolds said the hate crime charge stemmed from the fact that authorities believe Martinez burned the flag because of “what it represents as far as sexual orientation.”

The harsh sentence elevated the local crime story to international prominence, and created quite a stir on social media.
