multiple decades. While his formal training was in Russia, he immigrated to the United States in

1990. Mr. Kush is a U.S. citizen and lives in Las Vegas, where two of his children were born. His

art, in the style of Metaphorical Realism, is instantly recognizable and has been exhibited all over the

world. He has fine art galleries in California and Hawaii, and two galleries in Las Vegas, Nevada,

where he sells originals and limited edition reproductions, sculptures, art books of his works, and his

Российско-американский художник из Лас-Вегаса Владимир Куш подал в суд на американскую певицу Ариану Гранде, обвинив ее в плагиате двух своих картин. В его работах 1999 и 2000 годов «Свеча» и «Свеча 2» на фоне голубого неба в облаках горит гигантская свеча, а на месте фитиля находится силуэт женщины. Выпускник Московского художественного института им. Сурикова 2000 года Владимир Куш утверждает, что одна из сцен клипа God Is a Woman в исполнении певицы Арианы Гранде была снята по его картине. На данный момент ролик уже набрал 197 миллионов просмотров на YouTube.

Напомним, 25-летняя американская актриса и певица Ариана Гранде стала известной в 2009 году после роли Кэт Валентайн в сериале «Виктория-победительница». А на музыкальном поприще она заявила о себе в 2011 году, когда приняла участие в записи саундтрека к этому сериалу, после чего заключила контракт со звукозаписывающей компанией Republic Records. Ее песни не раз занимали уверенные позиции в первой десятке чарта Billboard Hot 100.

54-летний Владимир Куш известен картинами-метафорами. В свое время подрабатывал платными портретами на московском Арбате. В 1987 году стал постоянным участником выставок Союза художников. В 1990 году, после показе картин в немецком городе Кобурге, где большинство его работ были распроданы, уехал жить в Лос-Анджелес. В США арендовал для работы гараж, а так как не мог найти место для экспозиции картин, то вновь стал подрабатывать рисованием портретов на улице. Но в итоге все сложилось, теперь у него четыре персональные галереи.

Ariana Grande is being sued for copyright infringement over her video for “God is a Woman” by a Las Vegas artist.

Vladimir Kush has filed a lawsuit claiming that the video’s scene of a woman in a candle flame is “nearly identical” to paintings he created and copyrighted in 1999 and 2000, according to TIME.

Attorneys acting on behalf of him and his company, Kush Fine Arts Las Vegas, filed a lawsuit for federal copyright infringement in the US District Court in Nevada on Thursday, 31 January.

Kush is seeking unspecified monetary damages, alongside a court order for the video to be removed from internet. Grande has yet to comment on the lawsuit.

(LAS VEGAS) — A Las Vegas artist is suing pop music star Ariana Grande, alleging federal copyright infringement over an image of a woman in a candle flame in the pop star’s widely-viewed “God is a Woman” music video.

Representatives for Grande did not immediately respond Monday to messages about the lawsuit filed Thursday in U.S. District Court in Nevada by attorneys for Vladimir Kush and his company Kush Fine Arts Las Vegas.

The lawsuit calls the image that appears a little more than a minute into Grande’s 2018 music video nearly identical to paintings that Kush painted and copyrighted in 1999 and 2000.

Kush seeks unspecified monetary damages and a court order to remove the video from the internet.

The four-minute video has been viewed almost 200 million times on YouTube since it was posted last July.

The lawsuit lists Grande under the name Ariana Grande-Butera, along with defendants Universal Music Group and the video director, producer and production company.

Susan Gutierrez, an attorney who represented Grande in a 2016 copyright infringement lawsuit, declined on Monday to comment about the Las Vegas case.

The 2016 case, in Los Angeles, involved a songwriter’s claim that Grande’s song “One Last Time” was similar to his work of two years earlier. It was settled in August 2017.

Kush’s attorney in Las Vegas, Mark Tratos, represented silent magician Teller, of Penn & Teller, in a 2012 copyright lawsuit that found a Dutch entertainer guilty of stealing a Teller magic trick and selling it online.

Tratos declined on Monday to comment.

The sight of Ariana Grande dancing in a candle for her "God Is a Woman" music video was too much for one artist to stand ... because he says she stole the idea from his painting.

Vladimir Kush is suing Ariana over the imagery in the music vid which was released in 2018. If you've seen it, the singer dances in silhouette inside a candle flame -- Ariana's wick.

But, Vladimir says nearly 20 years earlier he made 2 paintings called "The Candle" and "The Candle 2" ... which both featured a woman as the wick with raised arms against a partially cloudy sky.

According to the suit, the similarity is uncanny ... and a rip-off. Vladimir says Ariana's video features the same cloudy sky, ring effect of clouds around the flame and the same light beams radiating from the flame.

The production company Ariana used has experience in stealing artistic works, according to Vladimir. In the suit, he says Freenjoy, Inc and its prez were also involved in producing Kendrick Lamar's "All the Stars" video -- and you might recall ... a different artist sued over that one, also claiming a rip-off.

Vladimir is suing Ariana and Freenjoy for copyright infringement, and wants an injunction to remove her music vid from the Internet. BTW, it already has nearly 200 million views ... so, the genie's kinda outta the bottle.

Meet Vladimir Kush, the Painter Suing Ariana Grande

Russian-born artist Vladimir Kush knows branding. While fans were busy calling him a Surrealist painter, he simply coined his own movement-of-one, known as Metaphorical Realism. (Google the name now, and all you get is Kush.) He’s a self-described self-made man. “It’s been a long and treacherous way,” he said during a recent conversation, discussing his commercial success. “There was no PR, no investments—it was done from scratch, just based on the appeal to the audience.”

By 2019, Kush seems to sit atop a veritable empire of his own devising, with private gallery outposts in Maui and Laguna Beach, as well as inside Caesar’s Palace in Las Vegas. There, a team of associates push Kush’s paintings and prints: bold, happily trippy compositions in which elephants sport tubas for heads and trees turn into humans. Kush’s mix of marketing savvy and franchise-style salesmanship brings to mind an unlikely partnership between Mark Kostabi and the late Thomas Kinkade.

The artist has been in the news lately thanks to the pop singer Ariana Grande, whose team is being accused of looting Kush’s imagery in the music video for “God is a woman.” Kush’s works depict a tiny woman dancing within the flame of a candle; Grande’s video portrays the star in a nearly identical scenario. It’s not the first time this has happened to him—Kush previously pursued a similar case against the pop singer Pink back in 2007. The artist is indignant, but also confident in his claim. (He’s also not a Grande fan—Pink Floyd and Moby are more his speed.)

“I feel there is a lack of ideas out there,” Kush said, reflecting on the appropriation of his work. “They think it’s going to go unnoticed…they change a few shapes.…Maybe they think, Vladimir Kush, it’s a Russian name—maybe he’s far away, he’s not even going to notice, and he doesn’t have the capacity to do anything about it.” Regardless of whatever minor tweaks the music-video director made to his imagery, Kush said that it was clearly his underlying concept that had been pilfered. “Once you start trying to do that, you’re tapping into Kush art,” he said. “You’re tapping into Metaphorical Realism, that’s been invented right here.”

If Grande thought that Kush was some scrappy amateur without legal recourse, she chose the wrong artist to borrow from. Kush’s original paintings, he said, retail for $30,000 to $40,000 (for 11-by-14-inch canvases) and can climb to $100,000 (for 30-by-40-inch works). His operation has also sprawled into other, complementary ventures. The Kush brand encompasses “sculptures, a jewelry line, books…we even have perfume,” the artist told me. “We have a watch—I designed a watch! I designed some furniture as well. Metaphorical Realism has a lot to say.” (Kush’s studio has also produced an adult coloring book iPhone app, called Aries the Sheep.)
