Корреспонденты также раздобыли переписку Ардженто, подтверждающую ее сексуальную связь с юным коллегой по фильму "Цыпочки".
Напомним, что ранее стало известно о том, что Беннетт обвинил Ардженто в сексуальных домогательствах и насилии. Его адвокат пригрозил ей судебным иском, в котором будет содержаться требование выплаты значительной компенсации морального ущерба. Ардженто согласилась выплатить 380 тысяч долларов дабы не допустить публичных слушаний, которые могли разрушить ее карьеру и испортить имидж одного из лидеров движения против сексуальных домогательств #MeToo.
Сама Азия Ардженто заявила, что у не никогда не было сексуальных отношений с Беннетом, и все обвинения подобного рода абсурдны. It's a crime in California for an adult to have sex with a person under 18.
Bennett later threatened legal action and, in April, Argento settled with him for $380,000 ... which her boyfriend, Anthony Bourdain, paid.

Sheriff Does About-face ...ASIA ARGENTO NOW INVESTIGATED FOR SEXUAL ASSAULT

The L.A. County Sheriff's Dept. has done an about-face and now says it will investigate allegations by a man that he was sexually assaulted by Asia Argento when he was 17 years old.
Several Sheriff's officials told TMZ Monday morning the department would ONLY investigate if the alleged victim -- now 22-year-old Jimmy Bennett -- came forward and filed a complaint. One official now tells us the media attention on the case has made them do an about-face.
Bennett claims when he was 17, Argento -- who became one of the first women in the #MeToo movement to accuse Harvey Weinstein of rape -- plied him with alcohol, performed oral sex on him and then got on top of him and had intercourse ... this according to documents obtained by the New York Times.
Argento settled with Bennett for $380,000 ... so says the NYT.

The Italian actress and director Asia Argento was among the first women in the movie business to publicly accuse the producer Harvey Weinstein of sexual assault. She became a leading figure in the #MeToo movement. Her boyfriend, the culinary television star Anthony Bourdain, eagerly joined the fight.
But in the months that followed her revelations about Mr. Weinstein last October, Ms. Argento quietly arranged to pay $380,000 to her own accuser: Jimmy Bennett, a young actor and rock musician who said she had sexually assaulted him in a California hotel room years earlier, when he was only two months past his 17th birthday. She was 37. The age of consent in California is 18.
That claim and the subsequent arrangement for payments are laid out in documents between lawyers for Ms. Argento and Mr. Bennett, a former child actor who once played her son in a movie.
The documents, which were sent to The New York Times through encrypted email by an unidentified party, include a selfie dated May 9, 2013, of the two lying in bed. As part of the agreement, Mr. Bennett, who is now 22, gave the photograph and its copyright to Ms. Argento, now 42. Three people familiar with the case said the documents were authentic.

NEW YORK -- Italian actress Asia Argento - one of the most prominent activists of the #MeToo movement against sexual harassment - recently settled a complaint filed against her by a young actor and musician who said she sexually assaulted him when he was 17, the New York Times reported. Argento, 42, settled the notice of intent to sue filed by Jimmy Bennett, who is now 22, for $380,000 shortly after she said last October that movie mogul Harvey Weinstein raped her, the Times reported.
Argento and Bennett co-starred in a 2004 film called "The Heart Is Deceitful Above All Things" in which Argento played Bennett's prostitute mother.
Bennett says in the notice that he had sex with Argento in a California hotel in 2013. The age of consent in California is 18.
The notice says the encounter traumatized Bennett and hurt his career, the Times reported.
The newspaper said it received court documents that included a selfie of Argento and Bennett in bed. Three people familiar with the case said the documents were authentic, the Times reported.
Argento became one of the most well-known activists of the #MeToo movement after she told the New Yorker magazine that Weinstein raped her at the Cannes Film Festival in 1997 when she was 21. Argento told the magazine that she continued to have a relationship with Weinstein because she was afraid of angering him.

Actress Asia Argento, one of the first prominent women to accuse disgraced movie mogul Harvey Weinstein of sexual assault, agreed to pay $380,000 to an actor who accused her of sexually assaulting him when he was 17 years old, The New York Times reported Sunday night.
The actor claimed that the assault took place in a California hotel room in 2013, according to the report. The age of consent in California is 18.
Neither Argento's representatives nor the actor's attorney immediately responded to Fox News' request for comment.
The newspaper obtained documents sent between lawyers for Argento and the accuser that laid out a payment schedule. The paper also obtained a photograph dated May 9, 2013 that showed the two lying in a bed together.
On that date, according to a notice of intent to sue document sent to Argento's then-lawyer in November, Argento met the actor at the Ritz-Carlton hotel in Marina del Rey, Calif. After giving him alcohol, Argento kissed him and performed oral sex on him before the two had sexual intercourse, the report said.
The notice of intent asked for $3.5 million in damages. The Times reported that the final agreement was reached in April of this year.
Argento, now 42, played a prominent role in the downfall of Weinstein, the former head of Miramax. In October of last year, The New Yorker published allegations by Argento that Weinstein forcibly performed oral sex on her in 1997.

Rose McGowan has responded to the news that fellow #MeToo activist Asia Argento reportedly settled an accusation of assault made against her by a former child actor.
According to documents obtained by the New York Times, the actor and director agreed to pay musician Jimmy Bennett a total of $380,000 over the course of a year and a half after allegedly assaulting him in a California hotel room when he was just over the age of 17 years old. The state’s legal age of consent is 18.
The documents report that Bennett was initially planning to sue Argento for $3.5m in damages citing emotional distress, lost wages and assault. He claims that his income dropped from $2.7m to $60,000 following the alleged assault which is said to have occurred after he played her son in 2004 film The Heart Is Deceitful Above All Things.
McGowan, who – alongside Argento – was one of 13 women to be featured in the first report detailing the alleged sexual harassment and assault history of disgraced film producer Harvey Weinstein, has expressed her heartbreak over the reports on Twitter.

Under California Penal Code 261.5 PC, a "statutory rape" takes place when any person engages in sexual intercourse with a person under the age of eighteen (18).1
The crime of statutory rape is also commonly referred to as "unlawful sex with a minor" or as "unlawful sexual intercourse."
Statutory rape is a crime regardless of whether the sex was consensual or even initiated by the minor (the supposed "victim" of the crime).2
The offense of statutory rape is a California "wobbler" offense. Depending on the circumstances it may be charged as either a misdemeanor or a felony.3
The age difference between the defendant and the minor is one of the major factors determining how the crime is tried. If the defendant is 21 or older and the minor is under the age of 16, the penalties are likely to be most severe.
In such a case they can include up to four (4) years in California state prison!
2.1. Misdemeanor statutory rape penalties
If you are charged with misdemeanor statutory rape under any of the circumstances above, the potential penalties include:
Informal (otherwise known as summary) probation ,
A maximum one (1)-year county jail sentence, and/or
Up to one thousand dollars ($1,000) in fines.18
2.2. Felony statutory rape penalties
Felony penalties for statutory rape include:
Probation (either informal or formal) with up to one-year county jail, OR
Sixteen (16) months, two (2) years or three (3) years in custody19
...UNLESS the defendant was 21 or older and the "victim" was under 16, in which case the potential sentence is two (2) years, three (3) years or four (4) years,20
Up to ten thousand dollars ($10,000) in fines.21
2.3. Civil penalties for California unlawful intercourse
In addition to the above punishment, an individual charged with California statutory rape may also face civil penalties. These are non-criminal fines that you can be forced to pay in addition to serving time and paying criminal fines. Only adult defendants (defendants 18 and older) can be made to pay these fines.22
Civil penalties depend on the age difference between the parties. The maximum penalties are:
Two thousand dollars ($2,000) if the so-called victim is less than two (2) years younger than the defendant,
Five thousand dollars ($5,000) if the "victim" is at least two (2) years younger than the defendant,
Ten thousand dollars ($10,000) if the "victim" is at least three (3) years younger than the defendant, and
Twenty-five thousand dollars ($25,000) if the "victim" was under 16, and the defendant was over 21.23

(a) Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a “minor” is a person under the age of 18 years and an “adult” is a person who is at least 18 years of age.
(b) Any person who engages in an act of unlawful sexual intercourse with a minor who is not more than three years older or three years younger than the perpetrator, is guilty of a misdemeanor.
(c) Any person who engages in an act of unlawful sexual intercourse with a minor who is more than three years younger than the perpetrator is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment pursuant to subdivision (h) of Section 1170.
(d) Any person 21 years of age or older who engages in an act of unlawful sexual intercourse with a minor who is under 16 years of age is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment pursuant to subdivision (h) of Section 1170 for two, three, or four years.
(e) (1) Notwithstanding any other provision of this section, an adult who engages in an act of sexual intercourse with a minor in violation of this section may be liable for civil penalties in the following amounts:
(A) An adult who engages in an act of unlawful sexual intercourse with a minor less than two years younger than the adult is liable for a civil penalty not to exceed two thousand dollars ($2,000).
(B) An adult who engages in an act of unlawful sexual intercourse with a minor at least two years younger than the adult is liable for a civil penalty not to exceed five thousand dollars ($5,000).
(C) An adult who engages in an act of unlawful sexual intercourse with a minor at least three years younger than the adult is liable for a civil penalty not to exceed ten thousand dollars ($10,000).
(D) An adult over the age of 21 years who engages in an act of unlawful sexual intercourse with a minor under 16 years of age is liable for a civil penalty not to exceed twenty-five thousand dollars ($25,000).
(2) The district attorney may bring actions to recover civil penalties pursuant to this subdivision. From the amounts collected for each case, an amount equal to the costs of pursuing the action shall be deposited with the treasurer of the county in which the judgment was entered, and the remainder shall be deposited in the Underage Pregnancy Prevention Fund, which is hereby created in the State Treasury. Amounts deposited in the Underage Pregnancy Prevention Fund may be used only for the purpose of preventing underage pregnancy upon appropriation by the Legislature.
(3) In addition to any punishment imposed under this section, the judge may assess a fine not to exceed seventy dollars ($70) against any person who violates this section with the proceeds of this fine to be used in accordance with Section 1463.23. The court shall, however, take into consideration the defendant’s ability to pay, and no defendant shall be denied probation because of his or her inability to pay the fine permitted under this subdivision.
